Las prácticas descritas a continuación constituyen una amenaza directa para los derechos de los trabajadores, la seguridad de los usuarios y el cumplimiento del marco legal del estado de Florida. 1. Fraude en la clasificación de trabajadores y explotación laboral encubierta Trip 2 impone jornadas de hasta 8 horas diarias de trabajo, bajo reglas estrictas impuestas directamente por la empresa (horarios, rutas, métodos de operación, control de desempeño), pero sin clasificar a los conductores como empleados, sino como “contratistas independientes”. Esta figura es utilizada de forma fraudulenta para evitar: • Pagar salario mínimo garantizado. • Otorgar beneficios laborales (como seguro médico, compensación laboral, horas extra o vacaciones). • Retener y reportar impuestos al IRS y al estado de Florida. Estas acciones violan el Fair Labor Standards Act (FLSA) y el Capítulo 448 de los Estatutos de Florida, además de contradecir la normativa del IRS, que establece que cuando una empresa controla cómo, cuándo y con qué se trabaja, existe una relación laboral formal. No se trata de un contrato independiente, sino de una relación empleador-empleado disimulada para evadir obligaciones. Esto es evasión fiscal y fraude laboral. 2. Violación de leyes de transporte: uso de seguros personales para actividades comerciales Trip 2 obliga a sus conductores a operar vehículos para fines comerciales utilizando pólizas de seguro personales, lo cual es totalmente ilegal en Florida. Según el Capítulo 627.7415 del Florida Statutes, todo vehículo usado para fines comerciales debe contar con seguro comercial. Esta práctica no solo es ilegal, sino altamente peligrosa, ya que: • Si ocurre un accidente, la aseguradora personal puede rechazar el reclamo por uso indebido de la póliza, dejando al conductor completamente desprotegido. • Los pasajeros no están legalmente cubiertos en caso de lesión o muerte. • Se expone a terceros y a la sociedad en general a un riesgo civil y penal inaceptable. • La empresa se desentiende de cualquier responsabilidad legal, trasladando todos los riesgos al conductor, lo cual es un acto de negligencia corporativa grave. 3. Riesgos para la seguridad pública La combinación de: • Conductores que trabajan largas horas sin seguro adecuado, • Bajo presión operativa, • Sin respaldo legal ni protección financiera, …representa un peligro latente no solo para los propios trabajadores y usuarios del servicio, sino para el público en general. Estas acciones pueden desembocar en tragedias, donde la empresa quedará impune gracias a la estructura fraudulenta que ha construido. 4. Notificación a las autoridades competentes Por todas las razones expuestas, esta situación será reportada ante las siguientes entidades: • Office of the Attorney General del Estado de Florida, por posibles delitos de fraude corporativo, evasión fiscal y violaciones laborales. • Florida Department of Labor, por violaciones al FLSA y uso indebido de contratos independientes. • IRS, por omisión de retención y reporte de impuestos laborales. • Department of Highway Safety and Motor Vehicles, por el uso ilegal de seguros personales en actividades comerciales. ⸻ Conclusión: Trip 2 no es simplemente una empresa mal gestionada. Es una estructura empresarial basada en la evasión de responsabilidades, tanto legales como humanas. Su modelo de negocio se sustenta en: • Explotar a conductores sin brindarles protección. • Operar al margen de las leyes de transporte. • Burlarse de los reclamos legítimos de empleados y clientes. Hago un llamado a otros trabajadores y víctimas a alzar la voz. Lo que ocurre aquí no puede seguir normalizándose. Las autoridades deben actuar de forma inmediata para evitar que este modelo de impunidad siga creciendo en nuestro estado. ### 2/5 — Fake Emergency Data Collection *2020-11-19* “We need drivers it’s urgent! We need as many as we can get” so i sign upBecause he doesn’t feel good about taking their grandma and grandpa to the doctors? Doing my good deed right making a little bit of cash on the side nope made it all the way through the sign-up process including giving my social and my drivers license basically my firstborn only to be told sorry “driver recruitment closed” A.k.a. thank you for your data your social and your drivers license we don’t need you anymore. ### 1/5 — Terrible app *2019-10-23* I used this app successfully prior to the recent upgrade. Since the new upgrade, I’m constantly logged off my account when making any selections within the app. This is extremely tedious especially when trying to pick up rides. I don’t receive rides on time and reaching customers has become a problem. After picking up rides the app then does not allow me to close that ride once the customer has been dropped off at the desired destination. I never receive more than one ride a day... Thanks again! ### 2/5 — Lost in the city *2018-07-11* This app needs a lot of work, since they started offering 2 trips together the actual trips are not sincronice more less to the location where your fist trip is going it takes you back or all around the city, the app never knows were your location is when it offers you another trip and if you accept that trip that pop up is most likely where you were when you started not where you are now. Example: 1. pick up in homestead 2. Pick up in Kendall one is going to Jackson hospital the other to Hialeah drop off the one in Jackson another call pop up you accept but is to pick up in homestead and in order to cancel you have to call dispatch and wait until there available cause you have 4 callers in front of you most likely for the same reason I’m calling.
