Denbury shall not be liable for any direct, indirect, consequential or any other losses or damages suffered or sustained by User or any third parties, whether based in contract or tort (including, without limitation, negligence) or otherwise, as a result of or in connection with use or application of the App, or any invention, technology or product produced using or incorporating the App, and User shall defend, indemnify hold harmless Denbury of and from all actions, causes of action, damages, demands, claims, losses, liabilities, costs and expenses of every nature or kind whatsoever, which may be suffered, sustained, paid or incurred by Denbury as a result of, or in connection with, any claim in relation to User’s use of the App.
