Non-functioinal on iPod Touch

This App does not work at all on the iPod Touch 4 G with IOS 5.0 installed.

Why does the App Store continue to allow such non-functional software to be sold?

Under consumer law we are due a refund in this circumstance.

Perhaps we should begin to organize a class action against Apple and the lying vendors it shills for.
