They DO see and capture your images, and in fact take the license to use them commercially.
From their Terms of Service:
“By uploading contents to our App, the user grants both us and fellow App users a non-exclusive worldwide license for that image. This license allows us to distribute the image, use it to create derivative works and other commercial purposes.”
How can they have it when it just ran on your phone?
Their ToS is the part they can’t lie on, that’s what the legal team uses to keep them from getting sued.

First and foremost, FaceXSwap is designed to work entirely on your device. All face-swap processing happens locally using on-device AI—your images and videos are never uploaded to our servers or stored by us. We do not collect, view, or retain your media. The section you quoted from our Terms of Service is a standard legal clause meant to cover scenarios where users might voluntarily share content through optional online features (such as future social or cloud-based options), and it is intended to protect both the app and users in such cases. However, I acknowledge that this wording can be confusing when read in isolation, especially since our core face-swap functionality is fully local and private. Our Privacy Policy clearly states that we do not access, collect, or use your personal photos or videos. You can find the relevant section here: FaceXSwap App Privacy Policy - Information We Collect: “This app strictly protects user privacy. All face-swapping functions are executed locally on the user's device. We do not collect, store, upload, or share any face data with third parties. Temporary data generated during processing is only held in memory and is deleted immediately after the operation.” We take user privacy very seriously, and our technical implementation reflects that: no internet connection is required for face swapping, and all media stays securely on your iPhone. That said, I truly appreciate you pointing this out. Legal documents can sometimes be broad and are not always aligned with the actual user experience. We are already working with our legal team to update the Terms of Service to better reflect our local-only processing model and to avoid any future misunderstandings.
