I just read through all of FOMO’s updated T&Cs, and some raise serious red flags:
🚩 They can suspend / terminate your account WITHOUT prior notice.
🚩 Your PRIVATE KEY is sent to you UNENCRYPTED via a third party. FOMO states that they are NOT responsible if it’s stolen “in transit to you.”
🚩The terms include mandatory arbitration, a waiver of jury trials, and a waiver of class actions. You are literally agreeing to never sue them if you get drained.
🚩 ZERO security guarantees, as stated: “WE MAKE NO REPRESENTATIONS REGARDING THE SECURITY OR SAFETY OF YOUR DIGITAL ASSETS OR THE SERVICES”.
🚩 They disclaim even DIRECT damages with no liability caps or minimums. The explicit goal is to owe you nothing, even for a total loss.
🚩 They do not guarantee that fees will be disclosed before your transaction.
🚩 They can change the rules whenever they want, and can secretly update the terms without your notice.
