UNETHICAL / ILLEGAL
The privacy policy also states that this is not HIPAA compliant.
Response from developer
Thanks for taking the time to write. A few clarifications: 1. Undertone is designed for clients and therapists to use together. Our app directs users to talk with their therapist before recording, and features an in-app guide on how to start the conversation - the best experiences on the platform come from users whose therapists are involved from day one. 2. On HIPAA - the law specifically governs providers and insurers. A private record you keep for yourself sits outside the law, per HHS's own guidance - the same way your journal does. Your record belongs to you alone, by design. Even so, we've intentionally built Undertone to meet HIPAA's technical safeguards, which is what the HIPAA-aligned standard in both the app and privacy policy refers to. 3. Mosaic builds tools for practicing clinicians, and Undertone runs on the same secure engine therapists across North America use for their own session documentation daily. We built undertone.co/for-therapists to answer exactly these questions - therapists are welcome there, and in our inbox at hello@undertone.co.
